Welcome to StyleElevationWithTara.com (the “Site”). These Terms and Conditions (“Terms”) govern your use of the Site and all services provided, including our style quizzes, style membership subscription, forums, and any other content or features (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. Accounts and Eligibility

  • Eligibility: The Services are intended for users 18 years of age or older. By creating an account or making a purchase, you represent that you are at least 18 (or the age of majority in your state). If you are under 18, you may use the Site only with the involvement and consent of a parent or guardian. The Site is not directed to children under 13, and we do not knowingly allow anyone under 13 to use our Services (see our Privacy Policy regarding children’s data).
  • Account Registration: Some features (such as taking quizzes or joining the membership) require you to create an account with a valid email address and password. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Account Security: You must notify us immediately at tara@styleelevationwithtara.com of any unauthorized use of your account or security breach. We are not liable for any loss or damage arising from your failure to safeguard your credentials.
  • Account Deletion: You may delete your account at any time through your account settings or by contacting us. Account deletion is irreversible – it will remove your profile and access to any Services (including membership content). If you delete your account while having an active subscription, it will be treated as a cancellation (see Section 3 on Subscription Cancellation), and no refund will be provided for any remaining period.

2. Services Overview

Style Elevation with Tara (“Company”, “we” or “us”) provides style inspiration and fashion-related content through: (a) free Seasonal Style Quizzes (including a base quiz and sponsored quiz version); and (b) a paid Style Membership Subscription that offers exclusive content and community features. Additional features include contact forms for inquiries, and a member forum for style-related discussions. By using any of these Services, you agree to follow these Terms and any additional guidelines or rules posted in relation to specific services.

3. Seasonal Style Quizzes

We offer an interactive style quiz that helps users discover their seasonal style. By participating in any quiz, you agree to the following terms:

  • Personal Data and Communications: To receive your quiz results, you will be asked to provide certain information (such as your name and email address). By submitting your email, you consent to receive an email with your quiz results and other follow-up style tips or marketing communications from us, as the quiz is part of our marketing and lead-generation program. (If you do not wish to receive any emails, please do not take the quiz.) All such emails will include an “unsubscribe” link or instructions to opt out of future emails. We honor all unsubscribe requests – you may opt out at any time, and we will stop sending you marketing emailsftc.govftc.gov.
  • Standard (Base) Quiz: For the standard Seasonal Style Quiz available on our Site, we do not sell or share your personal information with any third parties. Your quiz responses and contact information are used solely to send your results and occasional style updates from us. You can unsubscribe from these communications at any time by clicking the provided link in the email or by visiting our general opt-out page (link will be provided) to manage your preferences. We will never require you to share personal data with anyone else to take this base quiz.
  • Sponsored Quiz Version: We may offer a special version of the style quiz in partnership with a sponsor (for example, a local shopping mall), which will be clearly identified as a sponsored quiz (with the sponsor’s branding and a note that it is “in partnership” with that sponsor). This sponsored quiz is typically accessible only via a special link or QR code provided by the sponsor (not publicly listed on our Site). If you choose to take the sponsored quiz, you acknowledge and agree that: (a) we will share the contact information you provide (such as your name and email) and your quiz results with the sponsoring partner; and (b) you will be added to both our email list and the sponsor’s email list for marketing communications. By participating, you are effectively opting in to receive marketing emails from both Style Elevation with Tara and the sponsor. (If you do not agree to this sharing or to receiving sponsor communications, please do not take the sponsored quiz.) The sponsor’s communications will be subject to the sponsor’s own privacy policy and terms, and we are not responsible for their content or practices. However, both we and the sponsor will provide you with clear ways to unsubscribe from our respective marketing emails at any time. All marketing emails (whether from us or the sponsor) will include proper disclosures, our physical mailing addresses, and an unsubscribe mechanism as required by lawftc.govftc.gov.
  • No Fees; Optional Participation: The style quizzes are free to participate in and completely optional. Requiring an email and marketing opt-in is part of how we are able to provide the quiz results as a free service. If you do not wish to share your email or receive communications, you can choose not to participate.
  • Quiz Result Emails: The email you receive with your quiz results may contain personalized style recommendations, outfit ideas, and links to products. In the sponsored quiz version, those product recommendations will be limited to stores or brands located at the sponsor’s shopping center, as part of the partnership arrangement. We strive to ensure the result email focuses on delivering your requested style information; however, because it includes promotional content (especially in the sponsored version), it is considered a commercial email for legal purposes and will include all necessary disclosures and opt-out options.
  • Transactional vs. Marketing Nature: We treat the base quiz result email as a transactional communication (delivering a service you requested), but since we require opting into our mailing list to get the result, we also treat it as a marketing email to be safe. That means we include an unsubscribe link and our contact information on the email, and we fully comply with the CAN-SPAM Act’s requirements for commercial emailsftc.gov. Your quiz result email (and any follow-up style tip emails) will clearly state who the email is from and how you can unsubscribe. Rest assured, unsubscribing from marketing emails will not prevent you from receiving any future quiz result you explicitly request or other transactional emails (like purchase receipts or account updates).

4. Style Membership Subscription Service

Our Style Membership is a paid subscription service that provides members with exclusive style content, such as monthly and weekly fashion tips, videos, downloadable PDFs, shopping guides with affiliate links, and access to a private style Q&A forum. The following terms apply to the membership service:

  • Membership Access and Content: When you subscribe, you gain access to the members-only section of the Site. This includes all content released during the months of your active subscription. Content is released periodically (e.g., new tips or videos monthly and weekly). You will have access to all membership content that is published from the start of your subscription until your subscription ends. Please note: Membership content is time-sensitive and tied to the subscription period. You will not automatically gain access to content that was released before you joined or after your subscription lapses, except as explicitly described below.
  • Payment and Billing: All payments for the membership are handled securely through Stripe, our third-party payment processor. We do not store your full credit/debit card information on our servers; it is collected and processed on Stripe’s secure checkout pages. By subscribing, you agree to pay the membership fee (as displayed at checkout) on a recurring basis (monthly, unless otherwise specified) until you cancel. Your subscription will automatically renew each billing period (e.g., every month on the same date as your initial purchase) and your provided payment method will be charged, unless you cancel prior to the next billing date.
  • Failed Payments: If a recurring payment fails (for example, due to an expired or declined card), we will notify you and may attempt to re-bill within a short period. During this time, your account may be put on hold. It is your responsibility to keep your payment information up to date. If payment is not received within a reasonable time after the due date, we reserve the right to suspend or cancel your membership access (see Cancellation terms below).
  • Cancellation Policy: You may cancel your membership at any time. Cancellation can be done through your account settings or by contacting us at tara@styleelevationwithtara.com or (401) 578-7826. No refunds will be provided for the current billing period if you cancel early – instead, your membership will remain active until the end of the period you have already paid for, and then it will not renew. This means you will continue to have access to membership content and features until your current subscription term expires. After that, your access will cease unless you reactivate your subscription. (For complete details, see our separate “Cancellation and Refund Policy” below.)
  • Access After Cancellation/Lapse: Due to the nature of our digital content, once your subscription ends, your access to members-only content is limited:
    • We allow a grace period of 2 months after your last paid subscription period ends, during which you can still log in to your account and view any membership content that was available to you during your paid subscription. This grace period is intended to let you wrap up or save any materials you had access to.
    • If you do not reactivate your membership within those 2 months, your member account will be deactivated, and you will lose access to all membership content (including content from the months you previously paid for). Even if you decide to subscribe again in the future, you will not regain access to the content from your past membership period that was lost after deactivation. (In other words, if your account stays inactive beyond the grace period, we treat you as a new subscriber for content access purposes.)
    • 30-Day Content Rule: If your subscription lapses or is cancelled and then you re-subscribe within 30 days of the last active date, we will retroactively grant you access to the membership content that was published during that gap (up to 30 days). This is a courtesy in case you had a brief interruption. However, if more than 30 days pass between subscriptions, any content released during the time you were not subscribed will not be added to your account when you return. (You will only have access to new content going forward from the date of your re-subscription.)
  • No Prorated Refunds: We do not offer prorated refunds for unused time in your billing cycle. For example, if you cancel in the middle of a month, you will not receive a partial refund for the remaining days of that month – you will simply retain access until that month’s end. Similarly, if we must terminate your account due to a violation of these Terms or other policies, you will not be entitled to any refund for the remaining period.
  • Changes to Membership or Fees: We reserve the right to change our membership offerings, content schedule, or subscription fees in the future. If we do so, we will provide advance notice to active subscribers (for example, via email or a notice on the Site). If a fee change occurs, it will apply to the next billing cycle after the change is effective. If you disagree with any changes, you may cancel your subscription before the next billing; continued use of the membership after changes indicates acceptance.
  • Stripe and Third-Party Terms: Since payments are processed through Stripe, your transactions are also subject to Stripe’s Terms of Service and Privacy Policy. We are not responsible for errors or breaches on the part of third-party payment processors. However, we chose a reputable processor to ensure your payment data is handled securely.

5. Community Forum and User Conduct

As a member, you gain access to our private style Q&A forum where you can interact with other members and our team. This is a community space for asking style questions, sharing tips, and uplifting each other. By posting or interacting in the forum or any interactive area of our Site, you agree to abide by this Code of Conduct:

  • Respect and Civility: Always be respectful, kind, and constructive. Help everyone feel welcome. Do not harass, bully, or verbally attack others. Disagreements may occur, but must be handled politely and professionally. Treat others the way you’d like to be treated – with courtesy and empathy.
  • No Hate or Discrimination: Absolutely no content that is hateful, discriminatory, or derogatory toward any individual or group is allowed. This includes racism, sexism, homophobia, transphobia, religious or political attacks, or any form of bigotry. We have zero tolerance for slurs, threats of violence, or any encouragement of harm toward anyone.
  • No Inappropriate Content: Do not post any content that is pornographic, sexually explicit, graphically violent, or otherwise highly inappropriate for a general audience. Our community is intended to be a positive, uplifting environment focused on style – not a place for any obscene or “sketchy” material. Use good judgment when sharing images; if it’s not something you’d show in a professional or family-friendly setting, do not post it.
  • No Illegal or Prohibited Activities: You must not engage in or promote any illegal activities on the forum. Additionally, do not post content that infringes on someone else’s intellectual property or privacy rights (for example, don’t upload a photo you don’t have rights to, or someone’s personal information without permission). Piracy, illicit drug references, or any discussion that solicits illegal behavior is forbidden.
  • No Spam or Self-Promotion: The forum is for genuine conversations among members. Do not use it to spam, advertise unrelated products, or excessively self-promote. It’s fine to mention a personal blog or social media in context if it’s relevant to a discussion, but blatant advertising or recruiting is not allowed unless you have obtained prior permission from the site admin.
  • Quality of Contributions: Try to keep posts on-topic and in the appropriate forum categories. Do not deliberately derail discussions or flood the forum with repetitive content. If you share images (like outfit photos), ensure they are relevant and not excessively large or numerous (to maintain usability for everyone).
  • Privacy and Personal Data: Do not share personal sensitive information (yours or others’) on the forum. This includes contact details, financial information, or anything that could pose a security risk. Remember that content you post in the members-only forum is visible to other members, so consider your own privacy as well.
  • Uplifting Environment: Our goal is an uplifting community. Encourage and support fellow members. It’s okay to offer constructive critique if someone asks for style advice, but do so helpfully and positively. Negative vibes and personal sniping have no place here.

Enforcement of Code of Conduct: We rely on both automated tools and community reporting to keep the forum safe. Users have the ability to report any content or behavior they believe violates these standards. Our admins and moderators (which include the site owner and appointed staff) will review reports and take appropriate action. However, note that we do not (and cannot) pre-screen every post or monitor the forum 24/7. There may be times we miss something objectionable – if so, please bring it to our attention via the report feature or by contacting us. We reserve the right (but not the obligation) to remove or edit any user-generated content at our discretion, with or without notice, if we believe it violates the Code of Conduct, these Terms, or for any other legitimate reason. We also reserve the right to take any of the following actions against a user who violates the rules:

  • Warning: For a first-time or minor offense, we may send a private warning message and require that the offending content be edited or removed. Your account may be flagged internally for monitoring.
  • Content Removal: We may remove or hide any posts, images, or other content that violate our policies without prior notice to you.
  • Restricted Access: We may impose temporary restrictions on your account, such as read-only access (preventing you from posting or commenting) or other feature limitations, especially if we’re investigating a situation or you’ve had multiple minor infractions.
  • Suspension: For serious or repeated violations, your account may be suspended, meaning you will be unable to log in or use the Services for a period of time. Suspension may be used while we conduct a more thorough investigation into misconduct. During suspension, we may also review your past activity on the Site.
  • Termination (Ban): If violations are severe, illegal, or repeated despite warnings, we may permanently disable your account. A banned user will no longer have access to the membership content or forum, and will forfeit any remaining paid period without refund. Permanent bans are a last resort but will be used to protect the community if necessary.

Our decisions on enforcement are final. While we hope never to have to ban anyone, we prioritize the safety and positivity of the community. No refunds will be given if your account is restricted, suspended, or terminated due to a violation of these Terms or the Code of Conduct, as these actions are a result of your own behavior breaching the agreement.

6. User-Generated Content and License

By posting content on our Site (including but not limited to forum posts, comments, profile pictures, or any other materials), you retain ownership of your content, but you grant Style Elevation with Tara a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and adapt your content within the context of our Services. This license is only for the purpose of operating, promoting, and improving our community and Services. For example, we may display your question and the answers in the forum for other members to learn from, or we might excerpt a helpful tip you shared in a members’ newsletter (with credit to you). We will not sell your individual posts or images to third parties, and this license ends when you delete the content or your account (except to the extent others have already seen or engaged with it, or we’ve archived it as part of site backups).

You represent and warrant that you have all necessary rights to any content you post and that such content does not infringe or violate any third-party rights or laws. If you post a photo, for example, you should either own the photo or have permission to share it. You also agree not to upload anything that contains viruses or malicious code.

We do not endorse or guarantee the accuracy of user-generated content. All opinions and advice expressed by users are their own, not those of Style Elevation with Tara. We are not liable for any user content, but if you find something offensive or infringing, please report it and we will review.

7. Intellectual Property (Site Content)

All content provided by the Site and within the membership – including text, graphics, logos, button icons, images, videos, design layouts, compilations, and software – is the property of Style Elevation with Tara (Tara [Last Name]), or is used with permission/licensing. This includes the curated style tips, videos, articles, and PDF guides created by our team for the membership. The compilation of all Site content is protected by U.S. and international copyright laws. You may not copy, reproduce, distribute, publicly display, or create derivative works from our content without explicit written permission from us, except for personal, non-commercial use as a subscriber. For example, as a member, you may download a PDF style guide for your own reference, but you cannot upload it to another website or share it broadly. If you wish to share excerpts of our content on social media or elsewhere, please obtain permission or ensure it falls under fair use.

The name “Style Elevation with Tara”, our logos, and any slogans or trade dress used on the Site are trademarks/service marks owned by us. You are not granted any license or right to use these marks. Similarly, the sponsor’s names or logos (in the context of the sponsored quiz) are trademarks of their respective owners – they are used on our Site only to denote the partnership and belong to those third parties.

We respect intellectual property rights of others. If you believe that any content on our Site (including user posts or our own content) infringes your copyright or other IP rights, please notify us with details. We will promptly investigate and remove or disable access to material as appropriate, in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

8. Affiliate Links and Third-Party Content

Our Site and membership content may contain affiliate links to products or retailers. This means if you click on a product link and subsequently make a purchase, we might earn a small commission from the sale, at no additional cost to you. We only include affiliate links for products that we genuinely recommend or find stylish, and any compensation does not influence our opinions. We will always disclose when a link is an affiliate link, in accordance with Federal Trade Commission (FTC) guidelines requiring clear disclosure of material connectionsftc.gov. For example, on pages or posts containing affiliate links, you might see a disclaimer such as, “This page contains affiliate links, which means we may earn a commission if you make a purchase via those links.” The purpose of these affiliate earnings is to help support our business and continue providing quality content.

Please note that when you follow an affiliate link or any third-party link on our Site (such as links to retailers, sponsor’s websites, or suggested products), you will be browsing or interacting with a third-party’s site or service. We do not have control over those third-party websites, and these Terms and our Privacy Policy no longer apply once you leave our Site. The inclusion of any link on our Site does not imply our endorsement of the third-party (though we strive to partner only with reputable brands). You assume all risk for any transactions or interactions with third parties. We are not responsible for any issues arising from purchases you make from third-party websites, such as product defects, damages, or misuse of your information by those sites. 9. Disclaimers of Warranties

Use at Your Own Risk: Our Services (including all content, features, and materials on the Site) are provided on an “as is” and “as available” basis. While we strive to provide accurate, up-to-date style information and a reliable platform, we make no warranties or representations of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Site or the information, products, or services on the Site. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

For example, we do not guarantee that:

  • The membership content will meet your expectations or guarantee any specific results (fashion is personal, and what works for one person may not work for another). Our style advice is for informational and entertainment purposes – the decision on how to use it is yours.
  • The Site or membership content will be available at all times, uninterrupted, or error-free. We may occasionally need downtime for maintenance or experience technical glitches. We will try to fix issues promptly, but we cannot warrant a perfectly reliable service 100% of the time.
  • Any images, videos, or files you download from the Site will be free of viruses or contamination. (We do our best to maintain security, but you should have your own antivirus protections as well.)
  • The results of using the Site (such as improvements to your style or wardrobe) will be satisfactory to you. Style is subjective, and while we hope our guidance elevates your style, we cannot promise specific outcomes like an increase in social media followers, professional opportunities, or personal confidence – those results vary by individual.

Third-Party Services: Any third-party services, like Stripe for payments, SendGrid/Twilio for communications, or HoneyBook (if used as a CRM), are outside of our control. We cannot guarantee their performance, and you should refer to their terms for any warranties they provide. However, if you experience an issue directly caused by one of our integrated third-party tools (e.g., a payment processing error), contact us and we will do our best to liaise with the provider to resolve it.

Not Professional Advice: The content on this Site (including forum discussions and answers from admins or other members) does not constitute professional advice (legal, financial, health, etc.). It is focused on fashion and personal style. We are not liable for any decisions you make based on advice or information from the Site. If we mention health or body-related topics (for instance, dressing for your body shape), it’s meant in a general lifestyle context, not medical advice.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.

10. Limitation of Liability

To the maximum extent permitted by law, Style Elevation with Tara (and its owner, employees, affiliates, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Site or Services. This includes, but is not limited to, damages for lost profits, data loss, business interruption, personal injury, or emotional distress, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from or related to the Services is limited to the amount you paid to us in the six (6) months preceding the claim (if any). For example, if you have been paying a monthly membership fee, our liability to you will not exceed six months’ worth of those fees. If you have not paid anything (e.g., you only took the free quiz), our liability will be limited to a nominal amount (for example, $50). These limitations apply whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory.

Exceptions: Some states or jurisdictions do not allow exclusion or limitation of certain damages, so the above limitation may not apply to you in its entirety. In such cases, our liability is limited to the greatest extent permitted by law.

You specifically acknowledge that we are not liable for user-generated content or the defamatory, offensive, or illegal conduct of any third party and that any risk of harm or damage from the foregoing rests entirely with you. For instance, if another user posts something offensive and you incur damages as a result, we are protected by law (e.g., Section 230 of the Communications Decency Act) and these Terms from liability for that user’s content.

11. Indemnification

You agree to indemnify, defend, and hold harmless Style Elevation with Tara and its owner (Tara [Last Name]), officers, employees, partners, and agents from any claim, demand, lawsuit, or other proceeding (including reasonable attorneys’ fees and costs) arising out of or related to your use of the Site or Services, your breach of these Terms, or your violation of any law or rights of a third party.

In plain language, if your actions (or content you post) cause us to be sued or incur legal expenses, you agree to cover those costs. For example, if you upload a photo you don’t have rights to and the copyright owner takes action against us, or if you defame someone on our forum and they sue us, you will be responsible for the resulting damages or costs.

We will notify you promptly of any such claim and cooperate with you (at your expense) in defending it. You may not settle any claim that involves a financial obligation on or admission of liability by us without our prior written consent.

12. Privacy

Your privacy is very important to us. Our collection and use of personal information in connection with the Site is described in our Privacy Policy (see below). Please review the Privacy Policy to understand how we handle your data. By using the Site, you consent to the collection and use of information as outlined in the Privacy Policy.

If there is a conflict between the Privacy Policy and these Terms regarding personal data, the Privacy Policy will govern that issue, but these Terms will govern all other aspects of the Services.

13. Accessibility

We are committed to making our Site accessible to as many people as possible, including those with disabilities. Please see our Accessibility Statement below for more details on our efforts and how to contact us if you encounter any accessibility barriers.

14. Termination of Service

We reserve the right to terminate or suspend the Services (in whole or in part) or your account at any time, with or without notice, for any reason. This includes discontinuing the Site entirely, or terminating individual memberships/accounts that are inactive, or that we suspect are being used for fraud, abuse, or any illegal purpose. If we terminate the entire membership program or the Site, we will attempt to notify users in advance via the Site and/or email. In such a case, if you have an active subscription, we may provide a prorated refund for the remaining portion of your current billing cycle (this is one of the few instances where a refund might be offered, at our discretion).

If your account is terminated by us for violation of these Terms or other policies, you will not be eligible for any refund of fees paid, as noted earlier. If you are terminated, you must cease all use of the Site and you may not create a new account without our permission.

Survival: Any provisions of these Terms which by their nature should survive termination (such as intellectual property rights, disclaimers, limitations of liability, and indemnification) will continue to remain in effect even after your access to the Service is terminated.

15. Changes to Terms

We may update or modify these Terms from time to time. If we make material changes, we will post the revised Terms on this page with a new “Last Updated” date, and we may provide additional notice (such as an email to members or a notice on our homepage). It is your responsibility to review these Terms periodically. By continuing to use the Site after any changes become effective, you agree to the revised Terms. If you do not agree with the revised Terms, you should stop using the Services and, if applicable, cancel your membership.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to the Site or Services will be governed by and construed in accordance with the laws of the State of Colorado, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding concerning the Terms or the Site shall be brought in the federal or state courts located in Colorado, and you consent to the personal jurisdiction of such courts.

However, we encourage you to contact us first to seek an amicable resolution to any issue. We value our users and will try to resolve concerns through customer support when possible.

Arbitration (if applicable): (Optional – include if we want arbitration clause) At our sole discretion, we may require you to submit any disputes through binding arbitration on an individual basis. [If implementing, detail the arbitration process, rules (e.g., AAA), and any opt-out rights.]

Class Action Waiver: To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Miscellaneous

  • Entire Agreement: These Terms (along with the Privacy Policy, Accessibility Statement, and any other guidelines we post) constitute the entire agreement between you and Style Elevation with Tara regarding your use of the Services, and supersede any prior agreements or understandings.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remainder of the Terms will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. A waiver is only effective if in writing and signed by us.
  • Transfer/Assignment: You may not assign or transfer your account or any rights under these Terms without our prior written consent.
